What is a Spouse Open Work Permit?

What is a Spouse Open Work Permit?

A Spouse Open Work Permit allows the spouse or common-law partner of certain temporary residents (international students or foreign workers) to work for any employer in Canada without needing a job offer or Labour Market Impact Assessment (LMIA). It’s one of the most flexible permits offered by Immigration, Refugees and Citizenship Canada (IRCC), giving spouses the freedom to support themselves and contribute to Canadian society while staying close to their partner.

Who is Eligible?

Who is Eligible?

To apply for a Spouse Open Work Permit, the applicant must be legally married to or in a common-law relationship with:

  • A Canadian citizen or permanent resident, under specific sponsorship situations

  • A foreign national who holds a valid work permit in Canada

  • An international student currently enrolled in a Designated Learning Institution (DLI) and studying full time

The applicant must provide proof of the relationship (such as a marriage certificate or shared legal documentation), proof of the spouse’s legal status in Canada, and show intent to comply with the terms of the permit. The applicant must also pass medical examinations and security clearances, if required. Like all Canadian immigration applications, final approval is at the discretion of the visa officer, so building a strong case is essential.
