Understanding LMIA and Work Permit Requirements
For Employers:
To hire a foreign national, a Canadian employer must:
Demonstrate that no Canadian citizen or permanent resident is available to fill the position
Apply for and receive a positive LMIA (Labour Market Impact Assessment) from Employment and Social Development Canada (ESDC)
Provide a formal job offer, employment contract, and meet wage, benefit, and compliance standards set by Service Canada
Commit to record-keeping and monitoring as per compliance audits
For Foreign Workers:
To obtain a work permit based on LMIA approval, foreign workers must:
Secure a valid job offer supported by a positive LMIA
Submit an application to IRCC with the job offer letter, signed employment contract, and proof of qualifications (education, training, experience, certifications)
Undergo medical, background, and security checks as required
Apply from inside or outside Canada, depending on status and location
LMIA-based work permits are closed permits, meaning they are tied to a specific job and employer. The duration is typically aligned with the employment contract, commonly ranging from 1 to 2 years.
