To apply for refugee status in Canada, you must be physically present in the country or at a port of entry. You may be eligible if:

  • You have a well-founded fear of persecution due to your race, religion, nationality, political opinion, or membership in a particular social group.

  • You are at risk of torture, risk to life, or cruel and unusual treatment or punishment if returned to your home country.

  • You do not have access to protection in a safe third country (e.g., another country you traveled through or resided in safely).

  • You have no previous failed refugee claims in Canada or another signatory country (under certain agreements).

Inland vs. Outland Sponsorship

  • Inland Sponsorship: For couples living together in Canada. The sponsored person may be eligible for an Open Work Permit while the application is processed.

  • Outland Sponsorship: For couples where the sponsored person is living outside Canada. Processed via the visa office responsible for their country of residence.
